Recklessly or accidentally killing another person. (Commonly referred to as manslaughter) the unlawful killing of another person without premeditation or so-called "malice aforethought" (an evil intent prior to the killing)

Anyone present as accesory to the reckless or accidental killing of another person is guilty under this section
