NM03 - Stalking

  • (a) Knowingly making someone else feel unsafe through repeated and unwanted contact or communications such to a degree as to make oneself fear for the safety of their persons.

    • “contact or communications” for the purposes of section A shall be defined as:

    • Following an individual through use of automobiles, aircraft, boats, on foot, or other such similar methods.

    • Using Email, Telephone, SMS, Mail, Notes, or in person communication.

    • Watching one's home, workplace, or any location where the individual being followed may be.

  • (b) Not withstanding the provisions of (a) of the charge, the charge shall not be misconstrued as to prevent the legitimate and lawful following of persons for the purposes of reporting a crime, private detective work by a licensed body, legitimate law enforcement activities, or other such activities a reasonable person would not otherwise consider to be a violation of (a)
