# NM03 - Stalking

### <mark style="color:orange;">NM03 -</mark> <mark style="color:orange;"></mark><mark style="color:orange;">**Stalking**</mark>

* (a) Knowingly making someone else feel unsafe through repeated and unwanted contact or communications such to a degree as to make oneself fear for the safety of their persons.
  * “contact or communications” for the purposes of section A shall be defined as:
  * Following an individual through use of automobiles, aircraft, boats, on foot, or other such similar methods.
  * Using Email, Telephone, SMS, Mail, Notes, or in person communication.
  * Watching one's home, workplace, or any location where the individual being followed may be.
* (b) Not withstanding the provisions of (a) of the charge, the charge shall not be misconstrued as to prevent the legitimate and lawful following of persons for the purposes of reporting a crime, private detective work by a licensed body, legitimate law enforcement activities, or other such activities a reasonable person would not otherwise consider to be a violation of (a)
